These terms are the agreement between you and Stefan Stojanovic, Beograd, Serbia ("AtPlace", "we"), for the use of the AtPlace website and app (the "Service"). By creating an account or using the Service you accept them. If you do not agree, do not use the Service.
Our Privacy Policy explains what we do with your data and is part of these terms.
1. Who can use AtPlace
You must be at least 16 years old. You may hold one account, under a nickname that does not impersonate somebody else or a brand. You are responsible for what happens under your account and for keeping your password to yourself. Tell us at once if you think somebody else has access to it.
2. What the Service is
AtPlace lets you keep a map of places you have been, add photographs and notes to them, group them into trips, follow other travellers, message them, and share a live, read-only page of your map with anyone by link. We also maintain a curated catalogue of places.
The Service is provided as it is today and we keep improving it. We may add, change or remove features, and we may suspend the Service for maintenance. We aim for it to be available all the time but do not promise that it will be.
3. Your content
"Your content" means everything you put on AtPlace: places, coordinates, descriptions, notes, photographs, trips, profile details and messages.
It stays yours. We claim no ownership of it.
You give us permission to use it. By posting content you grant AtPlace a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to store, copy, resize, reformat, translate, adapt, display, distribute and otherwise use it, to:
- run the Service — showing your content to you, to the people you make it visible to, and, for public content, to anyone, including on your live map, on the Explore map, in search and feeds, and in link previews when you or somebody else shares a link to it;
- promote AtPlace — public content (your photographs, places and trips, with your nickname) may appear in our marketing: on our website, in the app, on our social-media accounts, in screenshots, videos and press material. We will not sell your content on its own or license it to third parties for their own purposes, and we will not use content from a private account or a private place for promotion.
The licence lasts for as long as the content is on the Service. When you delete content, or your account, the licence ends, except that: copies may remain for a short time in backups; content you already shared publicly may persist where others copied or cached it (for example a link preview on another site); and promotional material we published while the licence was in force does not have to be withdrawn, though we will remove your content from future material on request.
Where the law gives you moral rights (for example to be named as the author), you keep them; we credit your nickname wherever we show your content outside the map itself.
Public by default. New places and trips are public unless you make them private. Public content can be seen by anyone, with or without an account, and may be indexed by search engines. You control this: every place and trip has a private setting, and your whole account can be made private.
Photographs on other people's places. You may add photographs to a public place somebody else created. They stay attached to that place. You can delete your own photographs at any time; the place's editor may also remove a photograph that does not belong there. [If you delete your account, photographs you added to other people's places are deleted / kept without your name — choose one and keep it consistent with the Privacy Policy.]
You must have the right to post it. Only post photographs and text you took, wrote, or have permission to use. Do not post other people's photographs, or images of identifiable people who have not agreed to appear.
4. Rules
You may not use AtPlace to:
- post anything illegal, or sexual content, content involving minors in a sexual way, or content that threatens, harasses, defames, or incites hatred or violence against anyone;
- post somebody else's private information, or photographs taken where people expect privacy;
- infringe anyone's copyright, trademark or other rights;
- create fake places, fake accounts, or misleading content, or manipulate likes, saves or follows;
- send spam or unwanted commercial messages;
- upload malware, or try to break into, overload, scrape, or copy the Service or its data by automated means;
- work around limits, screening or blocks;
- use the Service for commercial advertising without our written agreement.
Screening and enforcement. Every uploaded photograph is screened automatically before it is shown; one that fails is refused. Anyone can report a photograph. We may remove content, restrict features, or suspend or close an account that breaks these rules or the law, with or without notice, and we may keep what is needed to handle a complaint or a legal request. If you think we got it wrong, write to us and a person will look at it.
5. Blocking, privacy and messages
You can block, mute and report people. Blocking removes any follow between you, stops messages, and hides your profile and places from that person. Messages are private between the people in them but are not end-to-end encrypted; we may access them to investigate a report or when the law requires it.
6. Curated and third-party content
The curated catalogue is compiled by us from public sources. Photographs of curated places come from Wikimedia Commons under their respective free licences, and map data is © OpenStreetMap contributors. Maps and satellite imagery are provided by third parties (OpenStreetMap, Esri, CARTO) under their terms.
Places, descriptions, best times and notes — ours and other users' — are shared for inspiration and may be wrong or out of date. Check before you travel. You travel at your own risk; we are not responsible for what you find, or do not find, when you get there.
7. AtPlace's own rights
The AtPlace name, logo, design, curated texts and software are ours or our licensors' and are protected by copyright and trademark law. These terms give you a personal, non-transferable right to use the Service; nothing more. Open-source components we use keep their own licences.
8. Your live map
Your live map is a public page. Anyone with its link can open it, without an account, and it updates on its own as you add public places. Sharing the link is your choice; if you no longer want it public, make your account private or make the places on it private. We may show a "made with AtPlace" mark on it.
9. Ending things
You can delete your account at any time in Settings. You are signed out everywhere immediately and the account and its content are erased after a 24-hour grace period, as described in the Privacy Policy.
We may close your account if you break these terms or the law, if we are required to, or if we shut the Service down. Where we can, we will give you notice and a chance to export your content. Sections 3 (as to content already shared), 6, 7, 10, 11 and 12 survive the end of your account.
10. No warranty
The Service is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free, secure, or that content on it is accurate. Nothing in these terms limits the rights you have as a consumer under the law of the country where you live.
11. Limitation of liability
To the extent the law allows, AtPlace is not liable for indirect or consequential loss, lost profits, lost data, or for anything that happens because of content posted by other users, third-party maps and imagery, or your travels. Where liability cannot be excluded, our total liability to you for all claims in any twelve-month period is limited to the greater of €50 or what you paid us in that period.
Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, for intentional or grossly negligent conduct, or for anything else that cannot be limited by law.
12. Indemnity
If you are not a consumer, you agree to compensate us for claims, losses and reasonable legal costs arising from your content or your breach of these terms.
13. Changes to these terms
We may change these terms. For changes that matter we will tell you in the app or by email at least 30 days before they apply; if you do not agree, delete your account before they take effect. Continuing to use the Service after that date means you accept the new terms.
14. Law and disputes
These terms are governed by the law of Serbia. If you are a consumer in the European Union or the United Kingdom, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim there. Any dispute goes first to us at the address below; we will try to resolve it within 30 days. Otherwise the courts of Belgrade, Serbia have jurisdiction, without prejudice to the rights of consumers to sue at home.
15. Copyright complaints
If you believe content on AtPlace infringes your copyright, write to atplaceapp@gmail.com with the link to the content, proof of your rights, and your contact details. We remove infringing content and close the accounts of repeat infringers. (US users: this address is our designated agent for notices under the DMCA.)
